A probate sale occurs when a homeowner passes away without a trust, or if the home
was taken out of the trust to refinance and was not put back into the trust which then requires the property to be sold under court supervision in to settle debts and distribute assets to heirs

- With a Will (Testate): The court supervises the distribution according to the will’s instructions.
- Without a Will (Intestate): The court decides how assets are distributed in accordance with California law.
